1. Acceptance of Terms

By downloading, installing, or using the Decor AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Apparent Group Limited ("we," "us," or "our"), a company registered in Hong Kong.

2. Description of Service

Decor AI provides AI-powered interior design services. The App allows users to upload photos of rooms and use artificial intelligence to redesign them, replace objects, apply different styles, and visualize home improvements.

3. User Accounts

  • Registration: To access certain features, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process.
  • Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. User Content

  • Ownership: You retain ownership of any photos, text, or other content you upload to the App ("User Content").
  • License: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content solely for the purpose of providing and improving the App's services (e.g., generating AI designs).
  • Responsibility: You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to use and authorize the use of your User Content and that its use does not violate any third-party rights (including copyright, privacy, or publicity rights).
  • Prohibited Content: You agree not to upload content that is illegal, offensive, pornographic, violent, or otherwise objectionable. We reserve the right to remove any User Content at any time.

5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law or regulation.
  • Infringe upon the rights of others.
  • Distribute malware, viruses, or harmful code.
  • Attempt to gain unauthorized access to the App's systems or user accounts.
  • Interfere with or disrupt the integrity or performance of the App.
  • Reverse engineer or attempt to extract the source code of the App.

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Apparent Group Limited and its licensors. The App is protected by copyright, trademark, and other laws of Hong Kong and foreign countries.

7. Subscriptions and Payments

  • Pro Subscription: Certain features of the App may require a paid subscription.
  • Billing: Subscriptions are managed and billed by the applicable app store (Apple App Store or Google Play Store).
  • Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Cancellations: You can manage and cancel your subscriptions in your app store account settings.
  • Refunds: Refund requests are handled by the respective app store in accordance with their refund policies.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included therein.

AI Disclaimer: The designs generated by the App are for visualization and inspirational purposes only. We do not guarantee the structural integrity, safety, feasibility, or accuracy of any generated designs. Consult with a professional architect, engineer, or contractor before undertaking any physical construction or renovation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Apparent Group Limited, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App.

Our total liability to you for any claims arising out of these Terms or your use of the App shall not exceed the amount you have paid to us in the past twelve (12) months, or one hundred US dollars ($100), whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless Apparent Group Limited and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, or b) a breach of these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
